The Homeowner Association can send a letter to a homeowner about an alleged non-compliance/violation of either a CC&R or a Rule & Regulation or both. However, a fine cannot be posted to an owner's account until the owner has had an opportunity for a hearing. In other words, owners have due process rights before a monetary penalty can be assessed.
